These Terms of Service ("Terms") govern your use of the Sonelle mobile application (the "App"), provided by Yiğit Güleç ("we", "us", "our"). By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.
1. Eligibility
You must be at least 13 years old, or the minimum age of digital consent in your jurisdiction (whichever is higher), to use the App. If you are under 18, your parent or legal guardian must consent to these Terms on your behalf.
2. License
Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable licence to download, install, and use one copy of the App on iOS devices that you own or control, solely for your personal, non-commercial use. This licence is granted, not sold. We retain all rights, title, and interest in and to the App and its content, subject to the App Store's own Licensed Application End User License Agreement.
3. Restrictions
You agree not to, and not to permit anyone else to:
- copy, modify, distribute, sell, lease, sublicense, or create derivative works of the App;
- reverse-engineer, decompile, or disassemble the App, except to the extent expressly permitted by applicable law;
- circumvent, disable, or interfere with any security, licensing, digital-rights-management, or feature-gating mechanism of the App;
- use the App in violation of any applicable law or regulation;
- use the App to harm, harass, or otherwise infringe on the rights of any other person;
- extract, scrape, or republish the audio, images, or other content of the App for any purpose.
4. Subscriptions
Sonelle offers two auto-renewing subscriptions through the App Store, both of which unlock the same premium content:
- Weekly Premium — billed weekly at the price displayed in the App at the time of purchase.
- Monthly Premium — billed monthly at the price displayed in the App at the time of purchase.
4.1 Auto-renewal
Your subscription automatically renews at the end of each billing period unless you cancel it at least 24 hours before the renewal date. Payment is charged to your Apple ID at the end of each renewal period. Renewals occur at the then-current price unless we change the price and give you notice through the App Store as required by Apple's rules.
4.2 Cancellation
You may cancel a subscription at any time by going to iOS Settings → [your name] → Subscriptions → Sonelle, selecting the subscription, and choosing "Cancel Subscription". Cancellation takes effect at the end of the current billing period; you will continue to have access to premium content until that date. Uninstalling the App does not cancel a subscription.
4.3 Free trials and introductory offers
If we offer a free trial or introductory price, the terms (price, duration, and conversion behaviour) are shown to you before you purchase. Free trials convert automatically to a paid subscription at the end of the trial period unless you cancel at least 24 hours before the trial ends.
4.4 Refunds
All purchases are processed by Apple. Refund requests must be submitted to Apple at https://reportaproblem.apple.com. We do not have the ability to issue refunds for App Store purchases directly.
4.5 Price changes
We may change the price of a subscription. Where required by Apple's rules or by applicable law, we will give you advance notice and the opportunity to consent to or cancel before the new price applies.
5. Content
All audio, music, ambiance, image, and other content in the App is licensed or owned by us or our licensors. You may not extract, share, redistribute, modify, or use that content outside the App. Custom Live Mix arrangements you create on your device are yours; we have no rights in them and do not transmit them.
6. Third-Party Services
The App integrates with Apple's iCloud (optional) and uses Google Firebase services for analytics and crash reporting, as described in our Privacy Policy. Your use of those services is also subject to their respective terms.
7. Disclaimer of Warranties
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT ANY WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.
Sonelle is intended for relaxation, focus, and entertainment. It is not a medical device. It is not intended to diagnose, treat, cure, or prevent any disease or condition, including sleep disorders, anxiety, or tinnitus. If you have a health concern, consult a qualified healthcare professional.
8. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL WE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, ARISING OUT OF OR RELATING TO YOUR USE OF THE APP. OUR AGGREGATE LIABILITY UNDER THESE TERMS WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU HAVE PAID FOR THE APP IN THE TWELVE MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (B) FIFTY US DOLLARS.
Some jurisdictions do not allow certain limitations of liability; the above limitations apply only to the extent permitted by law.
9. Termination
You may stop using the App at any time. We may suspend or terminate your access to the App if you breach these Terms or use the App in a way that violates applicable law. Sections that by their nature should survive (intellectual property, disclaimers, limitations of liability, governing law) will survive termination.
10. Apple-Required Terms
These Terms are between you and us, not between you and Apple, Inc. Apple is not responsible for the App or its content. To the extent these Terms and Apple's Licensed Application End User License Agreement conflict, Apple's terms govern only to the extent of the conflict. Apple is a third-party beneficiary of these Terms and may enforce them.
11. Governing Law and Disputes
These Terms are governed by the laws of the Republic of Türkiye, without regard to its conflict-of-laws principles. Any dispute arising out of or relating to these Terms or your use of the App will be resolved exclusively in the competent courts of Istanbul, Türkiye, unless mandatory consumer-protection laws of your country of residence provide otherwise. If you are a consumer resident in the European Union, the United Kingdom, or another jurisdiction whose laws guarantee you the protection of local courts, those rights are not affected by this section.
12. Changes to These Terms
We may update these Terms from time to time. We will update the "Last updated" date above when we do. Material changes will be announced in the App or via a release note. Your continued use of the App after the update constitutes acceptance.
